Inihalal ng Senate impeachment court nitong Lunes si Sen. Francis “Chiz” Escudero bilang presiding officer sa impeachment trial ni Vice President Sara Duterte, matapos ang 12-8 vote kasunod ng constitutional challenge kung sino ang dapat mamuno sa proceedings.
Nauna nang binuksan ni Senate President Sherwin Gatchalian ang trial at pinaalalahanan ang senator-judges na ang kanilang oath ay obligasyong “to do impartial justice according to the Constitution and the laws of the Philippines.”
“Due process and fair play must remain paramount at every stage of this trial. Let us be firm in the search for truth. And let us remain faithful to the rules of this Court, the rule of law, and above all, the Constitution,” sabi ni Gatchalian.
Tumuloy ang impeachment court sa pagpili kay Escudero kahit nagtaas ng punto si Sen. Alan Peter Cayetano at iba pang senador-judge na ang sitting Senate President ang dapat manguna sa impeachment court.
Giit ni Cayetano, dapat resolbahin agad ang presiding officer issue at ang bilang ng boto na kailangan para sa conviction dahil “threshold” questions ito na maaaring makaapekto sa validity ng trial.
“I want to avoid walkouts. I want to avoid any delays, Mr. President,” sabi ni Cayetano, kasabay ng babalang “amending the rules, implementing a null and void rule, and violating the Constitution will endanger this whole hearing.”
Matapos mahalal, sinabi ni Escudero na kailangang umusad ang impeachment court nang may prudence, caution, at impartiality dahil ang trial ay tungkol sa isa sa pinakamabigat na aksyon sa constitutional democracy: ang posibleng pagtanggal sa isang halal na opisyal bago matapos ang termino nito.
Inilatag din ni Escudero ang ilang pangunahing gabay sa trial, kabilang ang requirement na kailangan ng affirmative vote ng hindi bababa sa 16 senator-judges para ma-convict si Duterte, batay sa constitutional requirement na two-thirds of all members of the Senate.
Sa burden of proof, sinabi ni Escudero na nasa prosecution ito at hindi lilipat sa respondent.
“Let me be clear that the burden of proof in these proceedings rest upon the prosecution. It does not and will not shift,” sabi niya.
Sinabi rin ni Escudero na ilalapat nang liberal ang rules para payagan ang prosecutors na mailahad ang kaso, ang defense na subukin ang ebidensya, ang senator-judges na timbangin ang facts, at ang publiko na marinig ang buo at impartial truth.
Binalaan din niya ang senator-judges, prosecutors, Duterte, kanilang counsels, at witnesses laban sa public comments tungkol sa merits ng kaso.
Giit ni Escudero, hindi dapat maging political theater o personal attacks ang proceedings. /Bistado
