Marcoleta arestado sa P75-M plunder case; Defensor, Espiritu timbog din

Arestado si Sen. Rodante Marcoleta nitong Lunes, July 6, matapos maglabas ang Sandiganbayan Third Division ng warrant of arrest laban sa kanya at tatlo pang akusado sa P75-million plunder case kaugnay ng umano’y undeclared campaign donations para sa kanyang 2025 Senate bid.

Kasama ni Marcoleta sa kaso sina dating Quezon City congressman Mike Defensor at businessmen Joseph Espiritu at Aristotle Viray. Sina Defensor at Espiritu ay naaresto rin sa isang coffee shop sa Quezon City, habang si Viray ay hinahanap pa ng police tracker teams.

Dumating si Marcoleta sa Sandiganbayan nitong Lunes ng umaga kasama ang kanyang lawyers para sa hearing sa kanyang motions na i-quash ang plunder case at ipagpaliban ang issuance ng warrant of arrest. Nang ibasura ng korte ang motions, inilabas at isinilbi ang warrant laban sa kanya.

Ayon kay Department of the Interior and Local Government (DILG) Secretary Jonvic Remulla, parehong voluntary appearance at arrest ang nangyari.

“Was he arrested or did he surrender? It was both,” sabi ni Remulla.

“He went there voluntarily sa Sandiganbayan to file a motion to quash, subsequently when it was denied, we closed down the building, we arrived, we arrested him.”

Matapos ang return of warrant, dinala si Marcoleta sa Criminal Investigation and Detection Group (CIDG) headquarters sa Camp Crame para sa booking procedures, kabilang ang pagkuha ng mugshots, fingerprinting, at medical examination.

Sa harap ng media sa Sandiganbayan, iginiit ni Marcoleta na hindi siya magtatago at handa siyang harapin ang proseso.

“Pagpunta ko rito, inaasahan ko na lahat, mga proseso na gagawin. Kagaya ng sinabi ko sa inyo, ako ay hindi magtatago. Haharapin ko ang batas, ang asunto, sang-ayon sa pagkakaintindi ko sa mga batas natin,” sabi ni Marcoleta.

“Kailangan kong dumaan ng proseso. Kasama na po yung pagpunta ko rito, yung hangarin ko na kung i-serve po nila yung warrant of arrest, tatanggapin ko,” dagdag niya.

Ilang oras matapos ang arrest warrant, inaresto rin sina Defensor at Espiritu sa isang coffee shop sa Quezon City.

“Nag-uusap sila sa Starbucks sa QC. Inaresto sila at dinadala na sa Sandigan para sa return of warrant,” sabi ni Remulla.

Matapos ang return of warrant, dinala sina Defensor at Espiritu sa Camp Crame para sa booking process bago ang inaasahang paglilipat sa Quezon City Jail sa Payatas.

Sa video bago ang kanyang arrest, binatikos ni Defensor ang kaso at sinabing inuuna silang ikulong habang malaya pa umano ang mga sangkot sa flood control mess.

“We were the first to be thrown in prison on cases without basis. By sending us to jail, we can no longer be able to speak about corruption. We just want the truth to come out…[we want] transparency, accountability, and justice,” sabi ni Defensor.

“You can send us to jail and silence us, but we will not give up,” dagdag niya.

Sa isa pang pahayag, sinabi ni Defensor: “Nauna pa kaming makulong kaysa sa mga totoong nagnakaw sa kaban ng bayan. Makukulong nyo kami at mapapatahimik pero hindi po kami susuko.”

Ayon kay Philippine National Police (PNP) chief Gen. Jose Melencio Nartatez Jr., ipinadala na ang tracker teams sa Metro Manila at provincial addresses para hanapin si Viray.

“It’s actually better to surrender, to surrender to the nearest police station or even here at Camp Crame,” sabi ni Nartatez.

Nag-ugat ang plunder case sa alegasyong tumanggap si Marcoleta ng P75 million sa campaign donations mula kina Defensor, Espiritu, at Viray noong 2025 election period, ngunit hindi umano ito idineklara sa kanyang Statement of Contributions and Expenditures at Statement of Assets, Liabilities and Net Worth (SALN).

Ayon sa mga ulat, pumasok umano ang P75 million sa loob ng apat na araw noong January 2025. Nauna nang itinanggi ni Marcoleta ang wrongdoing at inilarawan ang kaso bilang fabricated.

Bukod sa plunder, nakasuhan din si Marcoleta ng paglabag sa Presidential Decree No. 46, na nagbabawal sa public officers na tumanggap ng gifts habang nasa puwesto.

Ipinaliwanag ni Sandiganbayan Associate Justice Karl Miranda na ang warrant of arrest ay hindi hatol ng guilt, kundi resulta ng finding ng probable cause batay sa records.

“The issuance of the warrant of arrest signifies only that after evaluating the records, the court found probable cause to believe that the accused committed the offense charged,” sabi ni Miranda.

“Let me stress, yung warrant of arrest does not constitute a determination of guilt. Hindi pa guilty ’yan. All the accused continue to enjoy the constitutional presumption of innocence until their guilt is proven beyond reasonable doubt,” dagdag niya.

“Again, the court’s proceedings are governed solely by the Constitution, the applicable laws, and the evidence properly presented before me– before it,” ani Miranda.

Dahil non-bailable offense ang plunder, inaasahang ikukulong sina Marcoleta, Defensor, at Espiritu sa Quezon City Jail sa Payatas matapos ang processing at medical clearance. /Bistado
