Ipinag-utos ng Trial Chamber III ng International Criminal Court (ICC) ang pag-freeze sa perang nakuha kay former president Rodrigo Duterte noong inaresto siya sa Pilipinas noong March 2025 at dinala sa ICC detention facility sa The Hague, Netherlands.
Kaugnay ito ng crimes against humanity case ni Duterte na nakaugat sa kanyang war on drugs.
Lumabas ang desisyon sa defense filings na ginawang publiko noong Biyernes, June 26, habang sumasagot ang kampo ni Duterte sa request ng prosecution na ma-access ang materials na nasa custody ng ICC Registry.
“The Trial Chamber granted the Prosecution’s request to freeze any money that had been seized and further ordered the Registry to provide an inventory of the items obtained from Mr. Duterte upon his arrest,” sabi ni defense lawyer Peter Haynes.
Hindi pa isinasapubliko kung magkano ang perang nakuha kay Duterte nang arestuhin siya. Ayon sa ICC Registry, nananatili ang seized cash sa custody ng chief custody officer ng detention center.
Nauna nang tinawag ng defense na “otiose,” o hindi na kailangan, ang request na i-freeze ang pera dahil “will have no practical impact upon the existing state of affairs.”
Bukod sa cash, humihingi rin ang prosecution ng access sa ilang items na nakuha kay Duterte noong aresto, kabilang ang set of keys.
Ayon sa kampo ni Duterte, hindi nito tinututulan ang ilang bahagi ng request, pero kinuwestiyon nito ang access sa keys dahil kulang umano sa batayan.
“The request is, in substance, a fishing expedition,” sabi ni Haynes. “The Prosecution advances no evidential basis connecting the keys either to the commission or furtherance of the alleged crimes or to any assets that may be relevant to the investigation,” dagdag niya.
Sa submission na orihinal na inihain noong June 16, sinabi pa ng defense na hindi dapat payagan ang prosecution na gamitin ang inspection para humanap lang ng batayan pagkatapos.
“The basis of such a request must exist before the investigation is undertaken, not emerge as a result thereof. The prosecution cannot be permitted to examine the keys in order to articulate, post facto, the evidential foundation required to justify that examination in the first place,” ayon sa defense.
Para sa iba pang seized items, hiniling ng defense na limitahan ang access sa personal information ni Duterte at ng kanyang pamilya na hindi relevant sa investigation.
“Such information should also be destroyed or permanently deleted at the earliest possible opportunity,” dagdag ng defense.
Mahigit isang taon nang nasa ilalim ng ICC custody si Duterte. Noong April 2026, kinumpirma ng ICC judges ang crimes against humanity charge laban sa kanya kaugnay ng anti-drug campaign, kung saan hindi bababa sa 6,000 katao ang napatay sa police anti-illegal drug operations.
Ayon sa mga human rights group, maaaring umabot sa 30,000 ang bilang kung isasama ang mga vigilante-style killings.
