Abogado ni Duterte sa ICC, give up na bago pa ang trial

Bago pa man magsimula ang formal trial kay dating President Rodrigo Duterte sa International Criminal Court (ICC), nag-give up na ang kanyang lead counsel na si Nicholas Kaufman sa defense team.

Sa redacted court document na may petsang May 8, pormal na ipinaalam ni Kaufman sa ICC Trial Chamber III na magwi-withdraw siya bilang counsel ni Duterte. Ang kanyang one-year engagement bilang abogado ng dating pangulo ay natapos noong March 31, 2026.

Ayon kay Kaufman, bumisita ang defense team kay Duterte noong May 7. Doon ipinaabot ng dating pangulo ang desisyong kumuha ng bagong lead counsel. Naka-redact sa court document ang pangalan ng papalit na abogado.

Sinabi ni Kaufman na nakausap na niya ang bagong abogado, “who has indeed confirmed that he is ready, willing, and able to assume immediate representation and that his terms of engagement have been agreed.”

Tiniyak din niya sa ICC na hindi maaantala ang legal representation ni Duterte kahit aalis siya sa defense team.

“I am convinced that the continuity and efficacy of Mr. Duterte’s representation will remain assured through [REDACTED], who has a wealth of experience at the International Criminal Court, and the existing defense team. Counsel thanks [REDACTED] for his extremely graceful, supportive and collegial approach,” saad ni Kaufman.

Sa hiwalay na pahayag, nagpasalamat si Kaufman kay Duterte at sa supporters ng dating pangulo.

“If my withdrawal is approved, I am convinced that I will be leaving Tatay Digong in safe hands. May God bless the former President, the Duterte family, and the Filipino nation,” sabi niya.

Sinabi rin ni Kaufman na susunod siya sa ICC rules kung papayagan ang kanyang withdrawal.

“In the event that leave is granted, I affirm that I will adhere to all relevant provisions of the [ICC] Code of Professional Conduct concerning confidentiality and record-keeping provided for in Articles 8, 15, and 17,” ani Kaufman.

Sa hiwalay na court document noong May 8, pinayagan ng ICC Trial Chamber III ang request ni Dov Jacobs, isa pa sa legal counsel ng dating pangulo, na mag-withdraw bilang associate counsel ni Duterte. Ayon sa ICC, nire-reorganize ni Duterte ang kanyang defense team bilang paghahanda sa trial.

Dumating ang shake-up matapos kumpirmahin ng ICC Pre-Trial Chamber noong April 23 ang lahat ng charges laban kay Duterte at i-commit siya sa full trial.

Ayon sa tatlong pre-trial judges, may “substantial grounds to believe” na si Duterte ay “criminally responsible” sa tatlong counts ng crimes against humanity na inihain ng ICC prosecutor laban sa kanya.

Sinabi rin ng chamber na ang mga kaso ay kaugnay umano ng “widespread and systematic attack against a civilian population” sa Pilipinas mula November 1, 2011 hanggang March 16, 2019, sa konteksto ng “war on drugs” campaign.

Si Kaufman ay itinalagang lead defense counsel matapos madala si Duterte sa The Hague, Netherlands sa bisa ng ICC warrant noong March 2025. Iginiit niya noon na dapat palayain si Duterte dahil umano sa kawalan ng hurisdiksyon ng ICC, pero ibinasura ito ng ICC Appeals Chamber.

Nakatakda ang status conference para sa trial phase sa May 27. /Bistado
