Magiging “very difficult” ang pagdepensa kay Vice President Sara Duterte kung umabot sa Senate impeachment trial ang kaso, ayon kay House Committee on Justice chair at Batangas Rep. Gerville “Jinky Bitrics” Luistro.
Tinukoy ni Luistro ang bigat ng ebidensyang iniharap sa House impeachment hearings, lalo na ang umano’y diperensya sa pagitan ng Anti-Money Laundering Council records at Statements of Assets, Liabilities and Net Worth (SALN) ni VP Duterte.
“Even if I put myself in the shoes of the defense, I would really find it very difficult how to establish my defense, having seen the evidence presented by the complainants already, most especially the AMLC [Anti-Money Laundering Council] report vis-a-vis the SALN,” ani Luistro sa Saturday News Forum sa Dapo Restaurant sa Quezon City ngayong Sabado, May 9.
Nang tanungin kung anong strategy ang maaaring gamitin ng kampo ni Duterte sa Senate impeachment court, sinabi ni Luistro na hindi niya rin matukoy kung paano babaklasin ng depensa ang ebidensyang nailatag laban sa Vice President.
“Mas maganda siguro sa depensa itanong ‘yan. To be very honest with you, I’m totally clueless,” sabi niya.
Inaasahang tatalakayin ng House plenary ang committee report at Articles of Impeachment laban kay Duterte sa Lunes, May 11. Nauna nang naging unanimous ang boto para sa probable cause ng Committee on Justice at unanimous ding inaprubahan ang panel report para sa floor deliberations.
Sakop ng report ang alleged misuse of confidential funds, unexplained wealth, bribery, at threats laban kina President Ferdinand R. Marcos Jr., First Lady Liza Araneta-Marcos, at dating Speaker Ferdinand Martin G. Romualdez.
Sa committee hearings, sinuri ng lawmakers ang AMLC reports na nagpapakita ng combined P6.77 billion in covered and suspicious transactions na umano’y konektado kay Duterte at sa kanyang asawa na si lawyer Manases “Mans” Carpio.
Batay sa AMLC records, may 630 covered transactions at 33 suspicious transactions na kinasasangkutan umano ng mag-asawa mula 2006 hanggang 2025.
Noong Lunes, sinabi ni Atty. Peter Paul Danao, na nagsalita para sa kampo ni Carpio, na nilinaw umano ng Bank of the Philippine Islands na ang naiulat na “P2 billion” amount ay “P2 million” lamang, na umano’y dulot ng “system glitch.”
Ayon sa AMLC, umabot sa humigit-kumulang P4.42 billion ang combined inflows, habang lumampas sa P1.55 billion ang outflows. May P791.1 million naman na classified as “undetermined.”
Sinuri rin ng Justice Committee ang SALNs ni Duterte. Sa hearings, ipinakita na ang declared net worth niya ay tumaas mula P7.25 million noong 2007 hanggang P88.51 million noong 2024.
Napansin din ng komite na ang ilang SALNs mula 2019 ay umano’y nagpakita ng zero cash on hand at zero cash in banks, sa kabila ng bilyong pisong transactions na na-flag ng AMLC.
Nilinaw naman ni Luistro na probable cause lamang ang tinukoy ng House justice panel, hindi guilt. Aniya, may pagkakataon pa rin si Duterte na sagutin ang allegations at kuwestiyunin ang evidence kung umabot na ang kaso sa Senate.
“This trial may result to conviction, but it may also result to acquittal depending on the evidence which will be presented by the defense,” ani Luistro sa hiwalay na interview.
Pero sinabi niya na kung hindi maglalatag ng ebidensya ang kampo ni Duterte sa Senate, maaaring manatiling unrebutted ang kaso ng prosecution sa harap ng senator-judges.
“Pero kung hindi maglalatag ng ebidensya ang depensa, we can actually anticipate the appreciation of the senator-judges that the complainants’ evidence might be sufficient to support conviction,” sabi ni Luistro.
“Because it will remain unrebutted kung walang maglalatag ng ebidensya from the defense,” dagdag niya. /Bistado
