Taliwas sa paglilinaw ng Korte Suprema na ang “forthwith proceed” sa impeachment trial ay hindi awtomatikong ibig sabihin ay agad-agad, sinabi ni Senate President Vicente “Tito” Sotto III na para sa kanya, ang “forthwith” ay nangangahulugang kinabukasan.
“Kung matatanggap namin, we will act on it forthwith. Sa akin ang forthwith, the following day,” ani Sotto matapos ang caucus ng mga senador nitong Huwebes, April 30.
Tinalakay sa caucus ang posibleng timeline, procedural steps, at logistical requirements sakaling maipadala ng House of Representatives sa Senate ang Articles of Impeachment laban kay Vice President Sara Duterte.
“Pinag-usapan na namin ’yung mga possibilities, if we ever do receive the articles of impeachment, then we discuss the preparations that we need to do,” sabi ni Sotto.
“All these suggestions and preparations and possibilities of timing depend on whether the articles of impeachment reach the Senate,” dagdag niya.
Noong Miyerkules, nilinaw ng Supreme Court na ang “forthwith proceed” sa Article XI, Section 3(4) ng Constitution ay hindi kapareho ng “immediate.” Sa desisyong isinulat ni Associate Justice Rodil Zalameda, sinabi ng Korte na ang ibig sabihin nito ay “within a reasonable time, which may be longer or shorter, depending on the circumstances of each case.”
“While the Constitution requires the House of Representatives to act within a certain number of session days on an impeachment complaint, it does not specify a fixed timeframe for the Senate to start an impeachment trial. It simply provides that the trial ‘shall forthwith proceed,’ leaving the timing to the Senate’s discretion,” ayon sa Supreme Court.
Binasura ng Korte Suprema ang petition for mandamus ni lawyer Catalino Aldea Generillo Jr., na humiling na obligahin ang Senate na agad mag-convene bilang impeachment court para litisin si Duterte. Naghain siya ng petition matapos mag-adjourn ang Senate kahit naipadala noong February 2025 ang impeachment complaint laban kay Duterte.
Ayon kay Sotto, hindi sakop ng ruling ang magiging trabaho ng kasalukuyang Senate kung sakaling dumating ang Articles of Impeachment.
“That decision does not apply to the work of the Senate. It does not have anything to do with the work of the Senate. We are a coequal branch,” ani Sotto.
Nilinaw din niya na kailangang nasa session muna ang Senate para matanggap ang Articles of Impeachment bago ito makapag-convene bilang impeachment court.
“As soon as we receive it, then that’s the time we will officially decide on what to do with the timing,” sabi niya.
Ayon kay Batangas Rep. Gerville Luistro, chairperson ng House justice panel, pinakamagang botohan sa plenaryo kaugnay ng impeachment ang May 11. Sinabi ni Sotto na kung maipapasa ito ng House sa araw na iyon, inaasahan niyang maipapadala ang articles sa Senate sa May 12.
Sa May 13, aniya, tatalakayin na ito at magco-convene ang Senate bilang impeachment court.
Noong Miyerkules, April 29, unanimous na idineklara ng House Committee on Justice na may probable cause sa dalawang impeachment complaints laban kay Duterte dahil sa alleged corruption at violations of the Constitution. Kailangan ng suporta ng hindi bababa sa 106 House members, o one-third ng 318-member House, para maaprubahan ang impeachment at maipadala sa Senate. /Bistado
