Nakakita ang National Bureau of Investigation (NBI) ng prima facie evidence “with reasonable certainty of conviction” laban kay Vice President Sara Duterte kaugnay ng mga banta umano nito kina Pangulong Ferdinand Marcos Jr., First Lady Liza Araneta-Marcos at dating Speaker Ferdinand Martin G. Romualdez.
Iniharap ng House prosecution panel nitong Lunes sa Senate impeachment court si Atty. Jeremy C. Lotoc, NBI regional director at dating hepe ng Cybercrime Division.
Isinalaysay ni Lotoc ang ginawang imbestigasyon ng ahensya sa mga pahayag ni Duterte at ang naging konklusyon matapos suriin ang ebidensya.
Tinanong ni Presiding Officer Francis Escudero kung sapat ang nakalap na basehan para ihain ang criminal complaints, ngunit nilinaw na korte lamang ang makapagpapasya kung nagkasala ang Bise Presidente.
“Based on your investigation, was there enough basis to file a criminal complaint, as you did, for the crimes you charged the Vice President with, prima facie evidence only, not as to whether or not she did commit it or not, because only the court can determine that?” tanong ni Escudero.
“Yes, Your Honor. Based on our findings, we believe that the Vice President committed the crime of grave threats and inciting to sedition,” sagot ni Lotoc.
Muling nilinaw ni Escudero kung ang konklusyon ay para lamang matugunan ang pamantayan sa paghahain ng kaso.
“Prima facie evidence with reasonable certainty of conviction,” tugon ni Lotoc.
Sa ilalim ng 2024 Department of Justice-National Prosecution Service (DOJ-NPS) Rules, mas mataas ang pamantayang ito kaysa simpleng probable cause.
Nangangailangan ito ng ebidensyang sapat para patunayan ang lahat ng elemento ng umano’y krimen at magbigay-daan sa conviction beyond reasonable doubt kung hindi kokontrahin.
Hindi nangangahulugan ang natuklasan ng NBI na nahatulan na si Duterte. Korte lamang ang makapagtatakda ng criminal liability matapos masuri ang ebidensya at mabigyan ang akusado ng pagkakataong sagutin ang mga paratang.
Bahagi ang testimonya ni Lotoc ng presentasyon ng prosekusyon sa ilalim ng Article IV. Naunang tumestigo ang isa pang NBI witness tungkol sa authenticity at integrity ng recordings na naglalaman ng mga pahayag ng Bise Presidente.
Tinalakay naman ni Lotoc ang naging resulta ng imbestigasyon matapos suriin ang mga recording.
Sinabi niyang isinaalang-alang ng mga imbestigador ang freedom-of-expression defense ni Duterte, ngunit pinaghiwalay nila ang legal na pagpapahayag at pahayag na pinaniniwalaan nilang tumutugma sa mga elemento ng isang krimen.
“We failed to see any amount of freedom of speech in that utterances, Your Honor,” ani Lotoc.
“If we allow the argument that it is within the bounds of freedom of speech, if we allow that to become the norms of our society, then who would prevent anybody from doing the same to anyone?” dagdag niya.
“So imagine, Your Honor, the anarchy, the disorder and the chaos it would bring to our country,” sabi pa ni Lotoc. /Bistado
