Hindi raw personal na inaasahan ni House Lead Prosecutor Rep. Gerville “Jinky” Luistro ang ruling ng Senate impeachment court na ibalik ang sealed Bureau of Internal Revenue (BIR) box, pero iginiit niyang nirerespeto at tinatanggap ng prosecution ang desisyon ng korte.
Sa pahayag matapos ang Day 1 ng impeachment trial ni Vice President Sara Z. Duterte nitong Lunes, sinabi ni Luistro na naniniwala siyang dapat manaig ang constitutional mandate ng impeachment court sa mga usaping may kinalaman sa accountability.
“Hindi ko po inasahan personally because I have always believed that this is the impeachment court and the mandate of the Constitution should always prevail over any other statute,” sabi ni Luistro.
Ayon kay Luistro, ang confidentiality ng tax records ay nasa ilalim ng National Internal Revenue Code, pero ang impeachment trial ay nakatutok sa constitutional obligation na ipatupad ang accountability.
“Yung confidentiality dun ay papaloob sa provision ng National Internal Revenue Code. But what we are trying to address here is our obligation under the Constitution about accountability,” sabi niya.
Giit pa niya, dapat manaig ang Constitution kung may conflict ito sa anumang statute.
“Mayroong sinasabi sa batas if there is a conflict between the Constitution and any statute, the Constitution must always prevail,” ani Luistro.
Pero kahit hindi sang-ayon sa naging resulta, sinabi ni Luistro na tatanggapin ng prosecution ang ruling ng impeachment court.
“Pero regardless of that, we respect and accept the decision of the impeachment court,” sabi niya.
Umaasa pa rin ang prosecution na makukuha ang BIR records sa pamamagitan ng bagong request para sa subpoena na sumasaklaw sa mas malawak na listahan ng documents.
“We remain hopeful na makikita natin lahat ng BIR documents and like what I said earlier, meron tayong bagong request for issuance of subpoena which pertains to an expanded list of documents of the BIR,” sabi ni Luistro.
Ayon sa kanya, hindi lang income tax returns ang saklaw ng bagong request.
“Hindi na lang ITR kung hindi maraming dokumento which will be coming from the BIR,” sabi niya.
Sinabi ni Luistro na kasama sa expanded request ang income tax returns na pinaniniwalaan nilang nasa loob ng sealed BIR box.
“Part of that expanded list is the ITR. The ITRs which we believe are inside the sealed BIR box,” sabi niya.
Kung papayagan ang bagong subpoena request, sinabi ni Luistro na maaari rin nitong tugunan ang problemang idinulot ng pagbabalik ng BIR box.
“Then it will address also our challenge with respect to the opening of the BIR box,” sabi niya.
Ayon kay Luistro, naiintindihan ng prosecution na nag-iingat ang impeachment court dahil sa mga usapin sa ilalim ng National Internal Revenue Code.
“Nag-i-ingat din ang impeachment court because alam naman natin na meron talagang issue, meron question, meron challenge under the National Internal Revenue Code as to whether or not pwede bang i-disclose ang BIR records,” sabi niya.
Pero nanindigan siya na dapat bigyan ng pangunahing bigat ang accountability mechanism.
“We believe that impeachment court should give paramount importance to the accountability mechanism,” sabi ni Luistro.
Sa kabila ng ruling sa BIR box, sinabi ni Luistro na tagumpay pa rin ang Day 1 dahil nagsimula na ang impeachment trial.
“We are victorious. Tagumpay ang prosecution. Tagumpay ang taumbayan because we have waited for this impeachment trial for so long and it is happening right now,” sabi niya.
“That alone, we claim victory for what happened today,” dagdag ni Luistro. /Bistado
