Bank records ni VP Sara, mister bubuksan; ‘fishing expedition’ argument ng depensa, ibinasura

Nabigyan ng malaking panalo sa ebidensya ang House prosecution matapos pahintulutan ng Senate impeachment court ang pagpapalabas ng mga subpoena para sa tinukoy na peso bank records ni Vice President Sara Z. Duterte, kanyang asawang si Atty. Manases “Mans” Carpio at mga partidong konektado sa kanila.

Binasura ng korte nitong Lunes ang argumento ng depensa na isang “fishing expedition” ang paghingi ng prosecution sa mga dokumento. Nakita nitong malinaw, tiyak at may kaugnayan sa kaso ang hinihinging records.

Sinabi ni Presiding Officer Francis “Chiz” Escudero na sinuri ng korte ang mga kahilingan batay sa Section 3, Rule 21 of the Rules of Court, na nagtatakda ng mga kondisyon sa pagpapalabas ng subpoena duces tecum o utos para dalhin at isumite ang tinukoy na mga dokumento.

“In the case of a subpoena duces tecum, it shall contain a reasonable description of the books, documents or things demanded, which must appear to the court as prima facie relevant,” ani Escudero.

Ginamit din ng korte ang pamantayang itinakda sa Republic v. Sandiganbayan, G.R. Nos. 232724-27.

“A subpoena duces tecum may be issued if the tests of relevancy and definiteness are satisfied,” sabi ni Escudero, na sinipi ang Supreme Court.

“The books, documents or other things requested must appear prima facie relevant to the issue subject of the controversy—the test of relevancy,” paliwanag niya.

“Such books must be reasonably described by the parties to be readily identified—the test of definiteness,” dagdag niya.

Matapos suriin ang mga dokumentong tinukoy ng prosecution, nagpasya ang korte na pasado ang mga ito sa dalawang pamantayan at may kaugnayan sa unexplained-wealth allegations sa Article II ng Articles of Impeachment.

“The court finds that the requested documents meet the requirements set forth above. They are reasonably described, readily identifiable, prima facie relevant and material to the allegations under Article II,” pasya ni Escudero.

Hindi rin kinatigan ng korte ang pagtutol ng depensa batay sa bank secrecy at privacy ng depositor. Tinukoy ni Escudero ang pagsusuri sa bank records noong impeachment trial ni dating Chief Justice Renato Corona.

“This is not the first time that bank records have been examined by an impeachment trial,” aniya.

“Section 2 of Republic Act No. 1405 expressly recognizes cases of impeachment as an exception to the confidentiality of bank deposits and the rights to privacy of depositors,” dagdag niya.

Pinahintulutan din ang records mula 2007 hanggang 2021. Maaari lamang gamitin ang mga ito bilang paghahambing na financial baseline sa assets, transactions at business interests ni Duterte sa kasalukuyang termino. Hindi puwedeng gamitin ang records para magparatang ng hiwalay na impeachable offense sa labas ng kanyang termino.

Inaprubahan din ng korte ang pagkuha sa hiwalay at joint bank records ni Carpio at Duterte. Isinaalang-alang nito ang disclosure requirements ng Republic Act No. 6713 at ang absolute community of property sa ilalim ng Family Code, kung walang patunay ng ibang property regime.

“It is a legal and mathematical impossibility to determine the respondent’s true net worth or lawful income without examining the bank accounts of her husband,” ani Escudero. /Bistado
