Posibleng sa December pa maramdaman ng consumers ang pagtanggal ng 12-percent value-added tax (VAT) sa system loss charge sa kanilang electric bills, ayon sa Energy Regulatory Commission (ERC).
Sinimulan na ng ERC ang regulatory process kasunod ng direktiba ni Pangulong Ferdinand Marcos Jr. na bawasan ang pasanin ng mataas na singil sa kuryente.
Ayon kay ERC Chairperson at Chief Executive Officer (CEO) Francis Saturnino Juan, maaaring mailabas ang final resolution pagsapit ng September matapos ang public consultation. Kailangan pa itong ipadala sa Bureau of Internal Revenue (BIR), habang mangangailangan din ng panahon ang electric cooperatives at private distribution utilities para baguhin ang kanilang billing format.
“We fully support the President’s call to remove the system loss charge as a burden on electricity consumers. This is a cost for electricity that consumers do not actually receive,” ani Juan.
Naglabas na ang ERC ng draft resolution na nagdedeklara sa system loss charge bilang government-mandated pass-through cost. Sa ilalim ng panukala, hindi ito ibibilang sa gross receipts ng mga generation company at ng National Grid Corporation of the Philippines (NGCP) para sa VAT.
“We are already acting within the Commission’s existing authority while waiting for the necessary legislative and policy measures,” sabi ni Juan.
Kokonsultahin muna ang generation companies, distribution utilities, NGCP, consumers at iba pang stakeholders. Pagkatapos nito, isasapinal ng ERC ang resolution at ipapadala sa BIR.
Kabilang sa posibleng hakbang ang pag-amyenda sa Revenue Memorandum Circular No. 60-2026 para maisama ang system loss charge sa government-mandated charges na hindi pinapatawan ng VAT.
“If the necessary processes are completed, the system loss charge will be reflected separately on the electricity bill as a VAT-exempt item,” ani Juan.
Batay sa tantiya ni Juan, kung umabot sa ₱50 bilyon ang kabuuang system loss charges na binayaran ng consumers noong nakaraang taon, nasa ₱6 bilyon ang katumbas na VAT collection ng gobyerno.
Mas gusto naman ng Association of Electric Cooperatives na alisin ang VAT sa buong electric bill, hindi lamang sa system loss.
Sa halimbawang ₱10,000 electric bill, mas mababa sa ₱100 ang VAT sa system loss charge. Kung VAT sa buong bill ang aalisin, maaaring umabot sa humigit-kumulang ₱1,000 ang bawas.
Hindi eksaktong 12 porsiyento ang magiging reduction dahil may mga bahagi ng bill na VAT-exempt na, kabilang ang kuryenteng mula sa renewable energy sources.
May dati nang kinilalang VAT-exempt government-mandated charges ang BIR batay sa ERC issuances. Kabilang dito ang Lifeline Subsidy, Green Energy Auction Allowance, Universal Charges, Feed-in Tariff Allowance, Energy Tax, at Franchise and Real Property Taxes.
Samantala, lumahok ang ERC sa public hearing ng Senate Committee on Energy at Committee on Public Services tungkol sa apat na panukalang batas para higpitan ang system loss cap at bawasan ang system loss rate na ipinapasa sa mga consumer.
Inihain ang mga panukala nina Sens. Francis “Chiz” Escudero, Sherwin “Win” Gatchalian, Manuel “Lito” Lapid at Rodante Marcoleta.
Handa rin umano ang ERC na ipatupad ang anumang amyenda sa Electric Power Industry Reform Act (EPIRA) o ibang batas na ipapasa ng Kongreso.
“We will implement whatever amendments Congress may enact, and we will align our regulatory framework with the policy direction of the DOE,” ani Juan. /Bistado
