Sinimulan ng House prosecution nitong Martes ang presentation of evidence sa Day 2 ng impeachment trial ni Vice President Sara Duterte sa testimony ng National Bureau of Investigation (NBI) cybercrime investigator na nag-authenticate sa video ng umano’y grave threats laban sa top officials ng bansa.
Tumestigo si NBI Senior Agent John Mark Calilung sa Senate impeachment court na siya ang “agent on case” sa imbestigasyon ng NBI sa Nov. 23, 2024 online livestream ni Duterte.
Ayon kay Calilung, tungkulin niyang mangalap ng ebidensya sa imbestigasyon sa mga banta umano ni Duterte laban kina President Ferdinand Marcos Jr., First Lady Liza Araneta-Marcos, at dating Speaker Ferdinand Martin Romualdez.
“It means that I viewed, identified, preserved, collected, and authenticated digital evidence in the course of the investigation,” sabi ni Calilung sa direct examination ni lawyer Armando Virgil Ligutan, counsel for the House prosecutors.
Kabilang sa ebidensyang kinalap ng NBI ang video ng Nov. 23 online press briefing ni Duterte na livestreamed sa Facebook page ni dating presidential spokesperson Harry Roque.
Sinabi ni Calilung na in-authenticate niya ang recording sa pamamagitan ng pagkumpara ng screen-recorded copy sa original livestream.
“After screen recording, there’s an output video. I compared the output video with the November 23, 2024 video and ensured that the contents are identical,” sabi niya.
Matapos matiyak na identical ang content, gumawa siya ng hash value para mapanatili ang integrity ng recording.
“After ensuring that the contents are identical, I generated a hash value calculation on the video to ensure that the video won’t be tampered until presented in court,” sabi ni Calilung.
Pagkatapos tukuyin ni Calilung ang relevant timestamp, ipinalabas ng prosecutors sa impeachment court ang authenticated portion ng recording.
Sa video, sinabi ni Duterte: “Huwag kang mag-alala, ma’am, sa security ko, kasi may kinausap na ako na tao. Sinabi ko sa kanya, kapag pinatay ako, patayin mo si BBM, si Liza Araneta, at si Martin Romualdez. No joke. No joke. Nagbilin na ako, ma’am, ’pag namatay ako, sabi ko, huwag ka tumigil, ha, hanggang ‘di mo mapatay sila. And then he said yes.”
Ayon kay Calilung, doon nakatutok ang imbestigasyon. Tinukoy niya ang bahagi ng recording mula 1-hour, 15-minute mark hanggang 1-hour, 17-minute, 18-second mark ng mahigit dalawang oras na video.
Sinabi rin niya na nagsumite ang NBI ng preservation request sa Meta, parent company ng Facebook, para ma-preserve ang recording. Gumawa rin siya ng Affidavit of Authentication of Digital Evidence na nagdokumento sa forensic process.
Tumestigo pa si Calilung na nagsagawa ang NBI ng open-source investigation para alamin kung may kahalintulad na pahayag si Duterte bago ang Nov. 23 briefing.
Natukoy ng investigators ang Oct. 18, 2024 online press conference kung saan may pahayag si Duterte laban kay Marcos, kabilang ang remarks tungkol sa pag-iisip na putulin ang ulo nito, pagbatikos sa pamumuno niya, at bantang hukayin ang labi ni dating President Ferdinand E. Marcos Sr. at itapon sa West Philippine Sea.
Inilahad ng prosecution ang mas naunang recording para ilagay sa context ang Nov. 23 remarks ni Duterte. Ayon sa prosecution, parehong video ang sumusuporta sa Article IV ng Articles of Impeachment, na nag-aakusa kay Duterte ng culpable violation of the Constitution at betrayal of public trust kaugnay ng umano’y grave threats.
Naganap ang Nov. 23 livestream habang nasa labas si Duterte ng House detention facility kung saan nakadetine ang kanyang chief of staff na si Atty. Zuleika Lopez, matapos ma-cite in contempt ng House Committee on Good Government and Public Accountability sa inquiry sa confidential funds ng Office of the Vice President.
Habang naghahanda ang House officials na ilipat si Lopez sa Correctional Institution for Women, humarap si Duterte sa reporters sa livestream na kalaunan ay naging subject ng NBI investigation.
Sa testimony ni Calilung, inilatag ng prosecution ang evidentiary foundation para sa susunod pang witnesses at documentary evidence sa Article IV ng impeachment case. /Bistado
