Umaasa ang House prosecution panel na ipag-uutos ng Senate impeachment court ang pagbubukas ng sealed Bureau of Internal Revenue (BIR) box matapos tutulan ng defense hindi lang ang pagbubukas nito kundi maging ang pagmamarka nito bilang exhibit sa impeachment pre-trial ni Vice President Sara Duterte.
Sa press briefing nitong Huwebes ng gabi, sinabi ni lead prosecutor at Batangas Rep. Gerville “Jinky Bitrics” Luistro na hiniling ng prosecution na buksan ang sealed box dahil maaaring may laman itong mga dokumento kaugnay ng impeachment article hinggil sa alleged unexplained wealth ni Duterte.
“But sadly, they opposed the opening of the BIR box. They opposed as well the marking of the sealed BIR box,” sabi ni Luistro.
“Ako’y nagtataka kung ano kayang nakakatakot doon sa pagmamarkahan ng sealed box.”
Ayon kay Luistro, nananatiling umaasa ang prosecution na papaboran sila ng impeachment court.
“So we will be looking forward na sana itong BIR box na ito ay mabuksan na, sapagkat karapatan ho ng sambayanang Pilipino na malaman at makita ang nilalaman nito,” sabi niya.
Nakuha ang sealed evidence box sa pamamagitan ng subpoena ng House Committee on Justice noong impeachment proceedings nito, na nag-utos sa BIR na ilabas ang income tax returns (ITRs) ni Duterte at ng kanyang asawa na si Atty. Manases “Mans” Carpio. Sa halip na individual records, sealed box ang isinumite ng BIR.
“So we do not even know really the pieces of documents inside,” sabi ni Luistro.
“Although we understand na hiningi namin doon sa subpoena is ITR of the respondent and the spouse.”
Ayon kay Luistro, sinadyang hindi buksan ng House ang BIR box bilang paggalang sa awtoridad ng Senate impeachment court.
“We decided not to open because we believe in the power of the impeachment court,” sabi niya.
Ipinadala ang sealed box sa Senado kasama ng Articles of Impeachment at nasa custody na ngayon ng impeachment court. Ayon kay Luistro, mahalaga ang records dahil maaaring ipakita nito ang lawful income ni Duterte at ng kanyang asawa.
“This is very relevant because we will be able to know, to present before the impeachment court, the lawful personal income of the respondent and the spouse,” sabi niya. “And by knowing their lawful income, eh baka ma-justify nila ‘yung mga accusations.”
Sinabi ni Luistro na pumayag pa ang prosecution na ipagpaliban muna ang pagbubukas ng box at hilingin na markahan lamang ang sealed container bilang exhibit para ang impeachment court na ang magpasya kung bubuksan ito.
Giit niya, premature ang due process objection ng defense dahil marking of evidence pa lang ang proceedings at hindi pa usapin ng admissibility.
“They invoked due process kahit wala namang nalalabag na karapatan dito because this is just a marking of exhibit,” sabi ni Luistro.
“As a matter of fact, you cannot question the admissibility of the evidence yet. Sapagkat ‘yun ay dapat sa formal offer of exhibits mo pa lang gagawin,” sabi pa niya.
Ayon kay House prosecutor at Akbayan Party-list Rep. Jose Manuel “Chel” Diokno, naisumite na sa impeachment court ang motion ng prosecution hinggil sa sealed BIR box.
“The motions have already been presented to the court,” sabi ni Diokno. “I understand some oppositions will be filed, so the court may decide that either before or during the first day of the trial.”
Nang tanungin kung kailangan pa ng subpoena bago buksan ang sealed box, sinabi ni Luistro na nasa custody na ito ng Senado matapos ipadala kasama ng Articles of Impeachment.
“For the record, ‘yun pong box na ’yun ay trinansmit ng House dito sa Senate when we transmitted the Articles of Impeachment. So it is in the custody of the Senate,” sabi ni Luistro.
“So I don’t know to your question whether mangangailangan pa ba sila ng subpoena when in fact the sealed letter box is already in the custody of the Senate,” dagdag niya. /Bistado
