Tinanggap ng House prosecution panel nitong Huwebes ng gabi ang pagtatapos ng pre-trial proceedings sa impeachment case laban kay Vice President Sara Z. Duterte, matapos makumpleto ang marking ng documentary evidence at maisumite ang stipulations at manifestations ng magkabilang panig bago ang trial proper sa July 6.
Tumagal ng limang araw ang pre-trial conference, na ginanap noong June 18 at June 22 hanggang 25.
“Natapos na po ang marking of exhibits and terminated na rin ang pre-trial conference,” sabi ni lead prosecutor at Batangas Rep. Gerville “Jinky Bitrics” Luistro sa press conference matapos ang proceedings.
Kasama ni Luistro sa press conference ang mga public prosecutor na sina Leila de Lima, Jose Manuel “Chel” Diokno, Joel Chua, at Terry Ridon, gayundin ang private prosecutor at legal spokesperson na si Atty. Benjamin “Jay” Tolosa Jr.
Pinasalamatan ni Luistro ang Senate impeachment court sa pagtulong na maisulong ang proceedings sa kabila ng libo-libong dokumento para sa impeachment articles sa alleged unexplained wealth at confidential funds.
“We express our thanks and gratitude to the impeachment court, sapagkat through the intervention of the impeachment court, nakatapos kami mag-marking, especially with voluminous documents pertaining to the article on unexplained wealth and the article on confidential funds,” sabi niya.
Ayon kay Luistro, matagumpay ang pre-trial dahil nanatiling tutok ang prosecution sa mabilis na pagtatapos nito kahit may procedural issues na inihain ang defense.
“Definitely, sapagkat ever since our objective is to finish expeditiously,” sabi ni Luistro. “It was a clear position not to engage with those issues because our objective ever since is to finish this pre-trial conference expeditiously.”
Inilagay din ng prosecution sa record ang obserbasyon nitong humaba ang marking dahil tumanggi umano ang defense na gumamit ng common markings para sa identical exhibits na parehong balak iprisinta ng dalawang panig.
Ayon kay Luistro, mahigit 4,000 documentary exhibits ang minarkahan ng prosecution kaugnay ng confidential fund disbursements, kabilang ang higit 2,000 mula sa Office of the Vice President (OVP) at mahigit 1,900 mula sa Department of Education (DepEd). Dahil iginiit umano ng defense ang hiwalay na marking sa parehong documents, nadoble ang kabuuang bilang ng markings.
“So mamarkahan ng prosecution individually. And then because they refuse to agree that we mark in the same document, then they have to mark as well those 4,000 exhibits, which likewise form part of their documents. Walong libo in total,” sabi ni Luistro.
Ayon kay Chua, lalo pang tumagal ang proseso dahil kailangang pirmahan ng prosecution, defense, at impeachment court personnel ang bawat marked document.
Tugon naman ni Chua sa claim ng defense na may isang prosecution document na kulang ng pahina sa marking process, isolated lang ang insidente.
“Isolated lang po ’yun, hindi naman po lahat ng pagmamarkahan. Nangyayari naman po ’yan,” sabi ng Manila lawmaker.
Muling hiniling ng prosecution sa Senate impeachment court na payagan ang pagbubukas ng sealed Bureau of Internal Revenue (BIR) box, na anila’y may mga rekord na may kaugnayan sa impeachment article hinggil sa alleged unexplained wealth.
Ayon kay Luistro, sinadyang hindi buksan ng House ang box matapos itong matanggap mula sa BIR dahil naniniwala silang dapat ipaubaya ang usapin sa impeachment court. Pero ayon kay Luistro, tinutulan ng defense hindi lang ang pagbubukas ng box kundi maging ang pagmamarka nito bilang exhibit.
Hinihintay na ngayon ng prosecution ang pre-trial order ng Senate impeachment court at ang pormal na pagsisimula ng impeachment trial. /Bistado
