Hindi personal na dumalo si Vice President Sara Duterte sa pre-trial conference nitong Huwebes sa Senate impeachment court, pero sinabi ng House prosecutors na tuloy ang proseso sa ilalim ng rules.
Sa press conference sa House of Representatives, sinabi nina House Impeachment Spokespersons Rep. Zia Alonto Adiong ng Lanao del Sur 1st District at Rep. Renee Louise Co ng Kabataan Party-list, na handa pa rin ang prosecution kahit absent si Duterte at kulang umano sa substantive answers ang defense brief.
“We are glad by the orderly and smooth conduct of today’s pre-trial conference,” sabi ni Adiong.
Aniya, ipinakita ng conference “that the impeachment process is proceeding in accordance with the rules and on the proper constitutional track.”
Sinabi ni Adiong na lumahok ang public at private prosecutors. Nanatili rin ang private prosecutors para sa stipulation of exhibits. Inatasan ng impeachment court ang magkabilang panig na magsumite ng comments sa stipulation process sa June 22, bago isumite ang usapin for resolution sa June 25.
“We note, however, that Vice President Sara Duterte was not personally present during the pre-trial conference,” sabi ni Co.
“Instead, she was represented by a legal counsel who appeared and acted on her behalf before the impeachment court,” dagdag niya.
Ayon kay Co, tuloy ang prosecution sa pagsunod sa directives ng court.
“Nakita po natin na itong proseso na ito nagsimula, tutuloy-tuloy po natin ito hanggang matapos na ayon sa due process principles, sa rules ng Senate and even the Constitution,” sabi niya.
Sinabi rin ni Co na pinapayagan ng rules ang pagharap ng party o authorized representative, at nagprisinta umano ang defense team ng authorization para humarap ang counsel sa ngalan ni Duterte.
Pero giit ni Co, inaasahan ng publiko na haharap si Duterte dahil ilang taon nang hindi nasasagot ang mga tanong sa kaso.
“Ilang taong na pong hindi nasasagot yung mga tanong ng taumbayan and any further evasion is going to be another day, another week, another year of denial of justice,” sabi ni Co.
Ayon kay Adiong, may mensahe ang pagliban ni Duterte.
“Well, it speaks about how serious she is in facing these allegations,” sabi niya.
“I think it would be proper and would be more attuned to the demand of the people that she appears in the trial, in the pre-trial conference to display her seriousness and her attempt really to face the charges and also to show na wala siyang tinatago at wala siyang kinakatakutan,” dagdag ni Adiong.
Binatikos din ng House spokespersons ang defense pre-trial brief, na inilarawan nilang makapal pero mahina sa laman. Ayon kay Adiong, nakasandal ito sa general denial at paulit-ulit na pag-atake sa impeachment process imbes na direktang sagutin ang ebidensiya.
Ayon kay Co, dapat ipinakita ng pre-trial brief kung paano sasagutin ng defense ang mga alegasyon sa trial.
“The pre-trial brief sets the tone on how the defense will structure its answers,” sabi niya.
Sinabi ni Co na gumamit ang defense ng denials at generic descriptions ng witnesses o evidence nang hindi malinaw kung bakit ipinapasok ang mga iyon. Binanggit niya si Mary Grace Piatos at ang tanong kung paano kokontrahin ng defense ang Philippine Statistics Authority certification na walang ganoong tao sa records nito.
“Kailangan na pong maging mas makapagmatyag at masiyasat yung taumbayan sa mga magiging sagot sa trial proper,” sabi ni Co.
Ayon kay Adiong, mas magiging kapani-paniwala ang pahayag ni Duterte na wala siyang kasalanan kung personal siyang haharap sa impeachment court.
“Para sa amin, para sa taumbayan, mas magiging tapat yung kanyang sinasabi na wala siyang kasalanan kung maipaikita niya siya mismo ang humarap sa impeachment court,” sabi ni Adiong. /Bistado
