“Clearly then, the basis of computing the two-thirds must be the number of senators who are qualified to vote, not the 24 in the present Senate,” ani Davide sa memorandum.

“Therefore, 24 multiplied by two-thirds is always 16 in the abstract. But not always in reality,” ani Panganiban.

“Reality sometimes, Your Honors, changes the denominator in mathematics,” dagdag niya.

“By using two-thirds, the number of votes to convict will have to move depending on certain factors,” ani Puno.

Para kay Azcuna, malinaw naman ang constitutional phrase na “all the Members of the Senate.”

“As long as they are members of the Senate, they constitute the denominator in computing the threshold of two-thirds. Because all means all,” ani Azcuna.

“A threshold must be fixed, not variable. It must be determinable from the start,” dagdag niya.

“Isn’t that a denial of the respondent’s right to due process that the rule was changed in the middle of the proceeding?” tanong ni Senator-Judge Francis “Kiko” Pangilinan.

“Wala pa pong paglabag sapagkat hindi pa kayo bumaboto. In other words, it has not been implemented,” sagot ni Panganiban.

“Kaya there is no grave abuse of discretion in my humble opinion as of now.”

“I fully concur with my colleagues, Your Honor, because the question of the interpretation of the two-thirds is a procedural matter. And procedural matters can be retroactive. There is no vested right to a procedure,” ani Azcuna.

“So even if the trial has already started, you are midway through the trial, and you change the interpretation of the presiding officer, I think there is no violation of due process.”

/Bistado
