Pormal nang nag-convene ang Senado bilang impeachment court nitong Lunes, May 18, para simulan ang trial ni Vice President Sara Duterte.
Suot ang crimson robes, nanumpa ang mga senador bilang senator-judges ilang araw matapos matanggap ng Senado ang Articles of Impeachment mula sa House of Representatives. Si Sen. Camille Villar, bilang pinakabatang senador, ang nagpanumpa kay Senate President Alan Peter Cayetano bilang presiding officer. Pagkatapos nito, si Cayetano naman ang nagpanumpa sa iba pang senator-judges.
Absent sa proceedings si Sen. Ronald “Bato” Dela Rosa. Sa kabuuan, 23 senador ang dumalo sa convening.
Mabigat ang araw na ito sa impeachment calendar. Nauna nang inakyat ng Kamara sa Senado ang kaso matapos bumoto ang 257 lawmakers na pabor sa impeachment ni Duterte, habang 25 ang kumontra at 9 ang nag-abstain.
Sakop ng Articles of Impeachment ang mga alegasyon ng misuse of public funds kaugnay ng confidential funds ng Office of the Vice President at Department of Education, unexplained wealth, bribery, at threats laban kina President Ferdinand Marcos Jr., First Lady Liza Araneta-Marcos, at former House Speaker Martin Romualdez.
Sa session, sinabi ni Cayetano na mananatiling gamit ang umiiral na rules sa impeachment trial.
“For the record, Resolution No. 39 or the Rules of Procedure on Impeachment Trial should continue to apply. We further note that Rule 6, which therefore provides that the provisions of the Rules of the Senate and the revised Rules of Court shall apply suppletorily whenever applicable,” ani Cayetano.
Matapos mag-convene ang impeachment court, inutos ni Cayetano ang pag-isyu ng summons kay Duterte. Kailangan niyang maghain ng answer sa loob ng non-extendible period na 10 calendar days mula sa pagtanggap ng summons. Pahaharapin din siya sa Senado “upon notice.”
“The Sergeant-At-Arms is directed to serve the written summons on Vice President Sara along with a copy of the Articles of Impeachment,” ani Cayetano.
Kapag nakapaghain na ng answer ang kampo ni Duterte, bibigyan ang House prosecution panel ng limang araw para maghain ng reply. Pinayagan din ang filing ng pleadings at annexes nang personal o sa email.
Nilinaw din sa session na calendar days ang bibilangin, hindi working days, matapos magtanong si Senate Minority Leader Vicente “Tito” Sotto III.
Pagkatapos maisampa ang huling pleading, papayagan ang Clerk of Court na i-calendar ang kaso para sa pre-trial at maglabas ng notices sa mga partido.
“The Clerk of Court is hereby authorized to calendar the case for pre-trial and issue the corresponding notices to the parties after the last pleading is filed,” sabi ni Cayetano.
“Upon conclusion of the pretrial, the trial proper shall commence on a date and time fixed by the court of which the parties shall be duly notified,” dagdag niya.
Sa ilalim ng 1987 Constitution, Senado ang may sole power para litisin at desisyunan ang impeachment cases. Kailangan ng two-thirds vote ng lahat ng senador para ma-convict at matanggal sa puwesto ang isang impeached official. /Bistado
