Naghain ang limang senador ng resolusyon nitong Martes na nagsasabing hindi maaaring magbigay ang Senado ng “protective custody” o sanctuary kay Sen. Ronald “Bato” Dela Rosa.
Sa Senate Resolution No. 395, nanawagan sina Senators Francis Pangilinan, Vicente Sotto III, Panfilo Lacson, Risa Hontiveros, at Paolo Benigno Aquino IV na sumuko si Dela Rosa sa tamang awtoridad at dumaan sa legal na proseso.
Ayon sa resolusyon, dapat si Dela Rosa ay “voluntarily surrender to the proper authorities and seek judicial remedies in accordance with the Constitution and applicable laws and rules.”
Lumutang ang resolusyon matapos ang naunang paggamit sa Senate Resolution No. 44 bilang batayan para ilagay si Dela Rosa sa Senate “protective custody” habang naghahanap siya ng legal remedies kaugnay ng International Criminal Court-related proceedings.
Giit ng limang senador, may limitadong parliamentary immunity ang senators at members ng House of Representatives sa ilalim ng Constitution. Pero hindi umano nito pinapayagan ang Senado na magbigay ng sanctuary, immunity from arrest, o protective custody na lampas sa malinaw na parliamentary immunities.
Ayon sa resolusyon, ang Constitution ay “does not authorize the Senate to provide sanctuary, immunity from arrest or so-called ‘protective custody’ to any member beyond the constitutionally recognized parliamentary immunities expressly provided therein.”
Binibigyang-diin din ng panukala na walang probisyon sa Constitution o Senate rules na nagbibigay sa Senado ng kapangyarihang magbigay ng “institutional refuge” o immunity mula sa lawful arrest at surrender processes.
Sinabi ng mga senador na ang pagsunod sa legal na proseso at voluntary submission sa judicial authority ay “strengthen democratic institutions, reinforce constitutional accountability and uphold the principle that no public official is above the law.”
Binanggit din sa resolusyon ang Republic Act 9851, o Philippine Act on Crimes Against International Humanitarian Law, Genocide, and Other Crimes Against Humanity, na nagbibigay ng jurisdiction sa designated courts para sa ganitong mga offense.
Tinukoy din ng resolusyon ang mga naunang kaso ng lawmakers at former officials na dumaan sa judicial proceedings, kabilang sina dating Sen. Juan Ponce Enrile, dating senador at ngayo’y ML Party-list Rep. Leila de Lima, at dating Sen. Antonio Trillanes IV.
Sa huli, iginiit ng resolusyon ang paninindigan ng Senado sa Constitution, rule of law, at pantay na pananagutan ng public officials, “regardless of rank or position.” /Bistado
