Pinasasagot ng Senate impeachment court sina House prosecutor Bicol Saro Rep. Terry Ridon at private prosecutor Atty. Benjamin “Jay” Tolosa Jr. kaugnay ng posibleng paglabag sa sub judice rule sa impeachment trial ni Vice President Sara Duterte.
Kinumpirma ni Ridon nitong Huwebes, September 17, na natanggap niya ang show-cause order at magsusumite siya ng paliwanag sa korte.
“We respect the Senate Impeachment Court, we will answer the Show Cause Order, and we will continue doing our work,” ani Ridon.
Naunang inanunsyo ni Presiding Officer Francis “Chiz” Escudero ang pag-isyu ng show-cause orders sa dalawang prosecution members nang hindi muna pinangalanan ang mga ito.
Ayon sa impeachment court spokesperson, isang order ang may kaugnayan sa September 8 interview ng isang private counsel, habang ang isa ay tumutukoy sa interviews ng isang mambabatas noong September 14 at 15. Kusang nag-isyu ng orders ang korte at hindi ito hiniling ng depensa.
Sa ilalim ng Rule 18, sakop ng sub judice restriction ang public comments at disclosures tungkol sa merits ng pending impeachment trial.
Hindi naman tinukoy ni Ridon kung aling partikular niyang pahayag ang kinuwestiyon.
“Our role as prosecutors should be viewed in the entirety of the context of explaining to the public the goings-on of the trial. We have never asked the court to pre-judge. The impeachment trial is ongoing,” ani Ridon.
“We do not seek to influence the senator-judges,” dagdag niya.
Tiniyak niyang magpapatuloy siya sa pag-co-lead sa presentation ng Article II kaugnay ng alleged unexplained wealth ni Duterte habang sinusunod ang rules ng impeachment court.
Sa ilalim ng umiiral na guidelines, maaaring humantong ang unang violation sa public reprimand at admonition. Ang repeat violations ay maaaring patawan ng P30,000 fine at restrictions sa pagsasalita, pag-object o pag-examine ng witnesses sa impeachment floor. /Bistado
