Inirekomenda na ng Philippine National Police-Firearms and Explosives Office (PNP-FEO) ang pagkansela ng license to own and possess firearms at firearm registrations ni Sen. Ronald “Bato” dela Rosa kaugnay ng International Criminal Court arrest warrant laban sa kanya.
Sa press conference nitong Martes, May 26, sinabi ni FEO legal officer Lieutenant Colonel Domer Tadeo na nauna nang nagsagawa ng motu proprio investigation ang kanilang tanggapan bago pa pormal na hilingin ng National Bureau of Investigation ang pagkansela sa firearm privileges ng senador.
“So last week, we already gathered the necessary evidence regarding the cancellation or revocation of the LTOPF and firearms registration of our good senator, and we evaluated the grounds to be used insofar as the ICC warrant of arrest is concerned,” ani Tadeo.
Ayon kay Tadeo, nag-deliberate na nitong Tuesday ang FEO License Revocation and Restoration Board at natukoy na ang legal basis para sa rekomendasyong kanselahin ang lisensya at rehistro ng mga baril.
“As I said earlier, the process already started last week. This morning, our board conducted its deliberation. Our board is only a collegial recommendatory body,” paliwanag niya.
“With that, we identified the ground to be used in revoking or cancelling the LTOPF and firearm registrations of our good senator, together with the confiscation of the firearms,” dagdag ni Tadeo.
Ayon sa FEO, nakabatay ang rekomendasyon sa Section 4(g) ng Republic Act 10591, o Comprehensive Firearms and Ammunition Regulation Act, na nagbabawal sa ilang indibidwal na nahaharap sa criminal charges na humawak ng firearm licenses.
Pero ang pinal na desisyon ay manggagaling pa rin sa FEO chief, na siyang delegated authority.
“The FEO board recommends cancellation,” ani Tadeo, at sinabing maaaring lumabas ang desisyon “within a week.”
Kapag naaprubahan, pormal na aabisuhan si Dela Rosa tungkol sa cancellation order. Maaari rin siyang maghain ng reconsideration sa pamamagitan ng kanyang abogado.
Sinabi ni Tadeo na may opsyon din si Dela Rosa na boluntaryong isuko ang kanyang mga baril. Nilinaw niya na hindi kailangang personal na humarap ang senador sa FEO dahil maaaring dumaan sa kanyang legal counsel ang proseso.
Pero nagbabala ang FEO na kung hindi isusuko ang mga baril, maaaring magsagawa ng police action ang mga awtoridad.
“If the firearms are not surrendered, the team coming from the FEO or the Civil Security Group will proceed to the address for the confiscation,” ani Tadeo.
Nang tanungin kung susunod ang police action kung hindi ma-turn over ang mga baril, sagot niya: “Definitely police action will be done through proper and legal means.”
Tumanggi naman si Tadeo na sabihin kung ilan ang firearms na nakarehistro sa pangalan ni Dela Rosa, kahit may kumakalat nang reports online.
“The FEO is of the position that we will not divulge the number of firearms because it is personal information protected by the Data Privacy Act,” ani Tadeo.
Sa hiwalay na panayam sa Malacañang, sinabi naman ni PNP chief General Jose Melencio Nartatez na nasa humigit-kumulang isang daan ang firearms na nakarehistro sa pangalan ni Dela Rosa.
Nauna nang tinag ng NBI si Dela Rosa bilang “armed and dangerous.”
Nagbigay na rin ang Department of Justice ng go signal sa NBI at PNP para arestuhin si Dela Rosa matapos tanggihan ng Supreme Court ang kanyang hiling na temporary restraining order laban sa posibleng pag-aresto.
Ang ICC warrant ay kaugnay ng kasong alleged crimes against humanity na iniuugnay sa implementasyon ng madugong drug war noong administrasyon ni dating President Rodrigo Duterte.
Matapos manatili nang tatlong araw sa Senate premises sa ilalim ng protective custody, umalis si Dela Rosa kasama si Sen. Robin Padilla noong madaling-araw ng May 14, kasunod ng shooting incident sa Senate complex. /Bistado
