Iginiit ni Sen. Panfilo “Ping” Lacson na bawal ang “work-from-jail” para sa senator-judges na posibleng maaresto o makulong habang nakabinbin ang impeachment trial ni Vice President Sara Duterte.
Sa panayam sa DZBB, sinabi ni Lacson na kung may senator-judge na madetain, hindi online participation ang remedyo. Dapat aniyang humingi ang Senate impeachment court ng permiso sa Sandiganbayan o sa korteng hahawak ng kaso para maihatid ang nakakulong na senador sa Senado.
“One remedy is for the Impeachment Court to ask the Sandiganbayan or any court/s to which their cases would be assigned for ‘leave of court,’ and if granted, order the Bureau of Jail Management and Penology or their custodian/s to escort them to the Senate so they may participate in the impeachment trial of the Vice President. The senator-judges will be physically present,” ani Lacson.
“Work-from-jail is not allowed,” dagdag niya.
“We cannot allow online participation because that is reserved for force majeure and national emergencies.”
Ayon kay Lacson, pinapayagan lamang ng Senate rules ang teleconference, video conference, o iba pang electronic means sa panahon ng force majeure, extreme circumstances, o national emergency na pumipigil sa pisikal na pagdalo ng mga senador.
“Dapat pag-usapan namin kung ano ang remedyo para matuloy ang impeachment trial.Ang pwedeng gawin dun kung may nakakulong, kumuha ng leave of court, hindi ’yung online, kundi payagan sila ng korte, escortan sila sa Senado kung may authority o court order para mag-participate sila as senator-judges. Hindi pa rin pwedeng online,” ani Lacson.
“Ang remedy doon, hihingi ng permiso sa korte ang impeachment court at kung papayagan ng Sandiganbayan, ie-escort sila para may quorum o may mangyari. Hindi pwedeng online,” dagdag niya.
“Hindi naman pwedeng work-from-jail,” giit pa niya.
Pumutok ang usapin matapos mag-walkout ang minority senators noong Tuesday para pigilan ang botohan sa proposed rule change na magpapahintulot sa remote participation at electronic voting.
Tinitingnan ang panukala bilang posibleng daan para makadalo at makaboto si Sen. Ronald “Bato” Dela Rosa habang nagtatago sa publiko dahil sa International Criminal Court arrest warrant laban sa kanya.
Sa X post, sinagot ni Lacson ang pahayag ni Senate President Alan Peter Cayetano na umano’y “scampered out” ang minority bloc sa session hall.
“‘The minority group scampered out of the session hall.’ — SP Cayetano. No, Mr. Senate President, we quietly walked out because you scampered out of our rules and wanted to divide the house while we were still debating,” sulat ni Lacson.
Sa DZBB interview, sinabi ni Lacson na hindi maganda ang dating ng salitang ginamit ni Cayetano.
“Nag-scamper daw kami. Pangit pakinggan, para kaming bahag ang buntot lumabas ng plenaryo. Sila mag-scamper from the rules, gusto nilang madaliin,” ani Lacson.
Nagbabala rin siya na kung susubukan ni Dela Rosa na lumahok nang virtual, maaari pa itong makatulong sa law enforcers na matunton siya.
“If Dela Rosa wants to participate and uses his mobile device or laptop, he inadvertently helps law enforcement in tracking him down,” ani Lacson.
“If the law enforcers see his IP address, they have a good chance of getting him,” dagdag niya.
Samantala, umaasa pa rin si Lacson na makakakuha ng sapat na suporta ang minority bloc para mabawi ang majority at maitulak si Sen. Sherwin Gatchalian bilang Senate President.
“I hope so. Baka sakaling may ma-enlightened…at marealize nila na icorrect ang maging sa pananaw nila ay mali yung ginawa nila,” ani Lacson.
Dahil absent si Dela Rosa, epektibong 12 ang nasa majority bloc at 11 ang nasa minority bloc. /Bistado
