Nanawagan ang grupong Bantay Senado sa Senate Impeachment Court na buksan sa media at publiko ang June 18 pre-trial conference para sa impeachment trial ni Vice President Sara Duterte.
Giit ng citizens’ monitoring network, hindi procedural option ang transparency sa impeachment proceedings, kundi constitutional obligation.
Ayon sa Bantay Senado, inabisuhan ng Senate Impeachment Court ang mga partido na ang June 18 pre-trial conference “shall not be open to the media or public,” dahil kailangan umanong bigyan ang mga partido ng “the widest freedom and latitude” sa proceedings.
Mariing hinihimok ng grupo ang impeachment court na i-reconsider ang desisyon.
Sa pre-trial conference itinatalaga ang ground rules ng trial, pormal na minamarkahan ang ebidensiya, at tinutukoy ang mga testigo. Para sa Bantay Senado, hindi ito simpleng administrative o ministerial formality, kundi mahahalagang desisyong huhubog sa takbo ng buong paglilitis.
“The impeachment trial of a sitting Vice President is not a private legal dispute between two parties. It is a constitutional process conducted in the name of the Filipino people. Every stage of that process — including the pre-trial — must be conducted transparently. The public is not an optional participant to the proceedings,” sabi ni Prof. Cleve V. Arguelles, convenor and spokesperson ng Bantay Senado.
Nilinaw ng Bantay Senado na wala itong posisyon sa merito ng kaso laban kay Vice President Duterte at hindi ito kumakampi sa prosecution o defense. Pero kinilala ng grupo na may ilang miyembro ng prosecution ang pabor sa bukas at pampublikong pre-trial conference, posisyong sinabi nilang mariin nilang sinusuportahan.
Binigyang-diin din ng grupo ang mas malawak na democratic stakes ng pre-trial decision. Sa ganitong kalaking constitutional proceeding, anila, hindi pribilehiyong maaaring ibigay o ipagkait ng court ang public access ayon sa kaginhawaan nito. Public access umano ang isa sa batayan ng legitimacy ng buong impeachment trial.
“Impeachment trials and the information they present are matters of public concern. The public has the right to such information as matters of public concern, access to which is made more imperative by the state policy of full public disclosure. Closing it to the public and media without compelling constitutional justification may raise serious questions about the court’s commitment to due process and open justice. Transparency at the pre-trial stage is not incompatible with fair proceedings,” sabi ni Atty. Michael Tiu Jr., contributing legal expert ng Bantay Senado at Assistant Professor ng University of the Philippines College of Law.
Ayon sa Bantay Senado, itinataas nito ang isyu bilang citizen-monitoring body na may mandatong bantayan na ang buong proseso, mula pre-trial hanggang verdict, ay isinasagawa nang bukas, patas, at naaayon sa Constitution.
