Hihingi ng reconsideration ang Department of Agriculture–Bureau of Fisheries and Aquatic Resources sa Korte Suprema matapos ideklarang unconstitutional ang regulasyong nag-aatas ng electronic monitoring sa mga commercial fishing vessel.
Maghahain ang DA-BFAR ng motion for reconsideration kaugnay ng desisyon laban sa vessel monitoring regulation sa ilalim ng Fisheries Administrative Order No. 266.
Inaatasan ng nasabing patakaran ang mga Philippine-flagged commercial fishing vessel na maglagay ng vessel monitoring system at magsumite ng electronic catch reports.
Umaasa si Agriculture Secretary Francisco Tiu Laurel Jr. na muling pag-aaralan ng Korte Suprema ang desisyon upang maipagpatuloy ang paggamit ng sistema laban sa illegal, unreported and unregulated fishing sa karagatan ng Pilipinas.
“We are fairly confident the Supreme Court will reconsider the ruling, and allow us to use this internationally recognized vessel monitoring system as the most effective way to deal with illegal, unreported and unregulated (IUU) fishing as it relies on electronic data and not manual filing of commercial fishing firms,” ani Tiu Laurel.
Iginiit naman ng BFAR na iginagalang nito ang pasya ng Korte Suprema.
“BFAR respects the Decision of the Supreme Court, and we are filing a Motion for Reconsideration (MR),” ayon sa ahensiya.
Nangako rin ang BFAR na magkakaroon ng “constitutional safeguards” ang anumang monitoring framework na ipatutupad sa hinaharap.
Para sa ahensiya, hindi lamang simpleng tracking device ang vessel monitoring system. Ginagamit din ito upang matukoy kung sumusunod ang mga sasakyang pangisda sa mga regulasyon at conservation measures, kabilang ang pagbabawal sa pangingisda tuwing closed season.
“It is a frontline enforcement tool used to monitor compliance with regulations and conservation measures such as during closed fishing season to protect gravid female stocks in spawning and nursery areas from illegal exploitation,” paliwanag ng BFAR.
Nakatutulong din umano ang sistema sa pagpapatupad ng fishing restrictions, pagsubaybay sa pinagmulan ng mga huli, paglikha ng datos para sa science-based fisheries management at imbestigasyon laban sa illegal fishing operations.
Sa ilalim ng amended Fisheries Code of 1998, isang pribilehiyo at hindi karapatan ang commercial fishing license. Dahil dito, nakapailalim ito sa mga tuntunin at regulasyon ng pamahalaan.
Kasabay ng apela, rerepasuhin ng BFAR ang paraan ng pagpapatupad sa vessel monitoring system upang matiyak na matibay ito sa aspetong teknikal at naaayon sa Konstitusyon. /Bistado
