Nagbabala ang grupo ng mga kilalang law deans at professors na maaaring mauwi sa administrative at criminal liability ang sinumang senador na tatangging mag-convene bilang impeachment court para sa trial ni Vice President Sara Duterte.
Sa inilabas na pahayag nitong Lunes, sinabi ng legal scholars na wala nang discretion ang Senate kapag naipadala na ng House of Representatives ang Articles of Impeachment na inaprubahan ng hindi bababa sa one-third ng mga miyembro nito.
“Trial forthwith proceeds,” diin ng mga professor, habang binabanggit ang Article XI, Section 3 ng Constitution.
Ayon sa kanila, malinaw ang layunin ng framers na umusad ang impeachment process “as a matter of course.”
Lumabas ang pahayag sa gitna ng kontrobersiya matapos ang Senate leadership shakeup na nagpatalsik kay Senate President Vicente Sotto III at nagluklok kay Alan Peter Cayetano bilang bagong Senate chief sa araw na inaasahang ite-transmit ang impeachment articles laban kay Duterte.
Inakusahan ng law professors ang ilang senador ng pagtatangkang antalahin o ilihis ang impeachment proceedings sa pamamagitan ng procedural maneuvering at leadership changes.
“We decry the brazen attempts of members of the Senate to forestall the impeachment trial of the Vice-President,” saad ng statement.
Partikular ding binatikos ng signatories ang tinawag nilang “Escudero definition” ng constitutional term na “forthwith,” kaugnay ng naunang pahayag ni then Senate President Francis Escudero na maaaring tukuyin ng Senate ang timing ng trial ayon sa sarili nitong convenience.
Para sa professors, taliwas ito sa malinaw na wika at layunin ng Constitution.
Mas mabigat ang kanilang babala: ang mga senador na tatangging gampanan ang constitutional duty ay maaaring managot sa batas.
“Refusal of public officers to perform a duty imposed by law, particularly by the Constitution, constitutes dereliction of duty,” saad ng statement.
Idinagdag ng professors na ang pagbibigay ng “undue advantage and benefit on a person not entitled to it” ay maaaring maging criminal offense sa ilalim ng Republic Act 3019, o anti-graft law.

Ranhilio Callangan Aquino, Msgr. Gary Formoso, Fr. Jaime Achacoso, Dr. George Carmona, Dr. Juan Ruffo Chong, Dr. Manuel Solis, Linda Malenab-Hornilla, Melanie Pimentel, Fr. Jerome Rosalinda, at Fr. Lhem Naval.
Lumagda rin sina Dean Ada Maria Abad ng Adamson University College of Law, Dean Ma. Soledad Margarita Deriquito-Mawis at Prof. Carlo Cruz ng Lyceum of the Philippines University College of Law, Dean Marivic Trabajo-Daray ng Holy Name University sa Tagbilaran City, Prof. Roger Terence Camua ng University of Asia and the Pacific College of Law, at Dean Rabindranath Polito ng Misamis University College of Law.
Pinuri rin ng legal scholars ang 257 miyembro ng House of Representatives na bumoto para aprubahan ang impeachment complaint laban kay Duterte, at tinawag ang boto na “courageous.”
Inadopt ng House ang House Resolution No. 989 at kinatigan ang findings ng Committee on Justice na may probable cause para i-impeach ang Vice President sa iba’t ibang grounds.
Bukod sa impeachment issue, nanawagan din ang professors sa Philippine authorities na makipagtulungan sa international legal processes kaugnay ni Senator Ronald dela Rosa at ng International Criminal Court.
Hinimok ng grupo ang mga Pilipino na “see to the faithful compliance by all public officers of their sworn duty to uphold the Constitution and abide by the Rule of Law.” /Bistado
