Posibleng mag-convene ngayong May ang Senate bilang impeachment court at magsimula ang full-blown trial ni Vice President Sara Duterte sa June, sakaling makakuha ng sapat na boto ang House of Representatives para iakyat ang kaso sa Senado.
Ayon kay Senate President Pro Tempore Panfilo Lacson, kung maipapadala sa Senate ang Articles of Impeachment, may mga prosesong kailangang daanan bago magsimula ang aktuwal na trial.
“Once the articles of impeachment are transmitted to us, if we follow the processes, we’re talking of at least three weeks before the actual trial starts,” ani Lacson sa isang interview sa dzMM.
Sinabi ni Lacson na kung aaprubahan ng House ang committee report sa May 11, gaya ng mungkahi ni House Justice Committee chairperson Batangas Rep. Gerville Luistro, at agad itong ipadadala sa Senate, kailangang mag-convene ang upper chamber bilang impeachment court sa May 12 hanggang May 14.
Nauna nang sinabi ni Senate President Vicente Sotto III na walang delay na magaganap sa pag-convene ng impeachment court. Para sa kasalukuyang Senate leadership, sinabi ni Lacson na ang “forthwith” sa 1987 Constitution ay “immediately.” Nauna nang sinabi ng Supreme Court na ang “forthwith” ay nangangahulugang sa loob ng “reasonable time.”
Nilinaw ni Lacson na ang convening ng impeachment court isa o dalawang araw matapos matanggap ang Articles of Impeachment ay hindi pa full-blown trial. Kailangan pa ng preliminary conference o pre-trial para markahan ang pieces of evidence na parehong panig ay sasang-ayunang iharap.
Ayon kay Lacson, hindi kailangang dumalo ang lahat ng senator-judges sa bahaging ito, at sapat nang ang Senate President ang mamuno. Binanggit niya ang karanasan sa impeachment trial ni dating Chief Justice Renato Corona, kung saan nagdulot ng kalituhan ang surprise witnesses dahil walang pre-trial.
Sa House, kumpiyansa si House Committee on Public Accounts Chair Terry Ridon ng Bicol Saro Party-list na maaabot ang 106 boto, o one-third ng 318-member House, para ma-impeach si Duterte.
“Yung boto ng probable cause 53 votes na po ‘yun. So ang kailangan lang naman po namin 106 votes to impeach,” ani Ridon sa Saturday News Forum sa Dapo Restaurant sa Quezon City.
“Tingin ko naman, that is a number that will not be difficult to surmount at makuha,” dagdag niya.
Nakatakdang aprubahan ng House Committee on Justice ngayong Lunes ang committee report na naglalaman ng final consolidated Articles of Impeachment at kaukulang resolution. Kapag naaprubahan sa committee level, aakyat ito sa plenaryo.
“I’m quite certain in the next two weeks, magkakaroon na po ng debate sa plenaryo patungkol po sa impeachment ni Vice President Sara Duterte,” ani Ridon.
“As soon as it is approved at the committee level, it will go to plenary by next week. So pagdedebatehan na po ‘yan at the level of the plenary,” dagdag niya.
“As soon as we are done po at the level of plenary, I think within two weeks we can transmit to the Senate,” ani Ridon.
Nilinaw din ni Ridon na plenaryo ng House, hindi House Committee on Justice ang pipili ng impeachment prosecutors kung ma-impeach si Duterte.
“Ang mga pangalan [ng impeachment prosecutors], itong nagdaan, sabi may mga luma at may mga bago. Pero ang magpapasya diyan, hindi ang House Committee on Justice kundi ang plenary ng Kongreso mismo,” ani Ridon.
“That would be relevant only upon a plenary vote na to impeach the VP. Kasi siyempre if she does not get impeached, walang panel of prosecutors to talk about,” dagdag niya.
Ikinasa ni Ridon ang tatlong haligi ng kaso: alleged misuse ng confidential funds, unexplained wealth, at threats to kill President Marcos at iba pang top officials.
Tinukoy niya ang Commission on Audit directive na nagpapabalik umano sa Vice President ng P448 million in confidential funds. Binanggit din niya ang P6.77 billion in total transactions involving Duterte and her spouse, kabilang ang P4.4 billion in inflows, P1.5 billion in outflows na hindi umano reflected sa SALN, at P2.8 billion in supposed remaining balances na hindi rin declared.
“So nakita natin hindi lang isang beses, nakita natin hindi ito tinuturing na conditional at kahit conditional ito pa rin ay banta na dapat panagutan ng pangalawang Pangulo,” ani Ridon. /Bistado
